Αν προκληθεί ατύχημα εξ αιτίας ενός προϊόντος το οποίο δεν είχε σωστό φάκελο CE, τότε η υπαιτιότητα εξ ολοκλήρου ανήκει στον κατασκευαστή η τον εισαγωγέα του, με όλες τις επιγενόμενες επιπτώσεις

Ο Τεχνικός Φάκελος μια φορά γίνεται και πρέπει να είναι σωστός, για να έχει νόημα η Δήλωση Συμμόρφωσης CΕ.
